Vinogram is not a winery, producer, or seller of alcoholic beverages. We do not sell, ship, or handle any alcohol. All wine products made available for purchase through licensed winery partners. The winery is the retailer of record. Our role is limited to designing and providing custom label artwork for special occasions, which is then applied by the winery in accordance with applicable federal and state alcohol laws. By using this website, you acknowledge that any purchase or shipment of wine is conducted solely through a licensed winery, and you represent that you are of legal drinking age in your jurisdiction.
1. Age verification / Minimum legal drinking age
This website is intended only for individuals who are 21 years of age or older, or the legal drinking age in their jurisdiction.
By using this Site or placing an order through our platform, you represent and warrant that you are at least 21 years of age and that any recipient of wine is also of legal drinking age.
Licensed wineries fulfilling orders will perform age verification at delivery, which may include checking government-issued identification. If age verification cannot be completed, the shipment may be refused or cancelled in accordance with the winery’s policies.
2. Intellectual property, rights to images, and license grant
By uploading or submitting any images, text, logos, or other materials (‘Content’), you represent and warrant that you own all rights in the Content or have obtained all necessary rights, releases, and permissions to use the Content.
3. Prohibited Content and Content Guidelines
You agree not to submit Content that: (a) infringes third-party rights (copyrights, trademarks, privacy); (b) contains obscene, pornographic, or child sexual content; (c) is defamatory, harassing, hateful, violent, or promotes illegal activity; (d) uses a celebrity likeness, trademarked logo or copyrighted character without permission; or (e) violates any law or regulation.
4. Vinogram provides its services on an “as-is” basis.
To the fullest extent permitted by law, Vinogram shall not be liable for:
- The legality or ownership of user-submitted content
- Shipping delays or delivery failures
- The conduct or regulatory compliance of licensed winery partners
- Errors caused by incorrect information submitted by users
- Interruptions or technical failures of the Site
Vinogram’s total liability for any claim arising from use of the Site shall be limited to the amount paid, if any, for Vinogram’s services.
5. Legal Notice Regarding Alcohol Sale
Vinogram is not a winery, producer, retailer, or shipper of alcoholic beverages. Vinogram does not sell, offer for sale, ship, or take title to any alcohol.
All wine products displayed on this website are offered for sale, processed, and fulfilled directly by licensed wineries that are responsible for all alcohol sales, tax collection, compliance, and shipping in accordance with applicable federal and state laws.
Vinogram’s role is limited to providing design services for custom label artwork that may be applied by the winery to bottles sold through the winery’s licensed sales platform.
By using this website, you acknowledge that any purchase of wine occurs solely between you and the licensed winery and that Vinogram is not a party to the sale of alcoholic beverages.
Privacy Notice
To fulfill your custom label request, we collect and share limited personal information (such as names, dates, and shipping details) with the winery solely for the purpose of producing and delivering your order. We do not sell your data to third parties. By placing an order, you consent to this information being shared with our licensed winery partner(s).
Comments
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.
Media
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
